Woytek Auto & Offroad LLC — Terms of Service

These Terms of Service ("Terms") govern automotive diagnostic, repair, maintenance, and modification work performed by Woytek Auto & Offroad LLC ("Woytek Auto," "we," "us"). By scheduling an appointment, approving an estimate, delivering a vehicle for service, or submitting payment, the client acknowledges and agrees to these Terms, whether agreement is given in writing, electronically, verbally, or through conduct.
Florida Required Disclosures (Statutory)
Under Florida law, the client is entitled to a written estimate if the final bill will exceed $150. Woytek Auto will not exceed an authorized estimate amount without the client's written or oral authorization, as required by Florida law.
- The client may indicate whether replaced parts should be returned for inspection or disposed of after the repair. If no election is made, replaced parts are disposed of after repair, except where the part must be returned to a supplier as a core or warranty exchange.
- Florida Statute 403.718 requires a $1.00 fee for each new tire sold in the State of Florida.
- Florida Statute 403.7185 requires a $1.50 fee for each new or remanufactured battery sold in the State of Florida.
- These fees apply only if such items are sold.
This statutory disclosure is provided with every written estimate, repair order, and invoice. Approving an estimate is a request for and approval of that written estimate for the amount shown on it.
1. Scope of Services
Woytek Auto provides professional automotive diagnostic, repair, maintenance, and modification services using practices generally accepted within the independent automotive repair industry.
Due to the complexity of motor vehicles, diagnostics and repairs are intended to address identified concerns but do not guarantee the prevention of future, related, or unrelated component failures. Work performed is limited strictly to the service line(s) specifically authorized by the client. If related issues, safety findings, corrosion, age-related deterioration, or adjacent failures remain outside the authorized scope, those risks remain and are not eliminated by a limited or partial repair.
2. Client Responsibilities
The client agrees to:
- Provide accurate vehicle information and disclose known or suspected issues and relevant service history.
- Provide accurate contact information and respond promptly to authorization requests.
- Remove all personal belongings from the vehicle prior to service. Woytek Auto is not responsible for lost, stolen, or damaged personal items.
- Disclose any pre-existing damage at drop-off. Vehicles receive an observational visual check-in at drop-off; this is not comprehensive photographic documentation.
3. Estimates and Authorization
An estimate is an approval-facing figure for the work described. A final invoice reflects the authorized work actually performed.
If the scope of work grows beyond the original authorization, the client will be notified and may approve or decline the additional work before it is performed. Woytek Auto will not exceed an authorized amount without further authorization as required by Florida law. Authorized labor and ordered parts are non-refundable. If the client declines recommended work, the vehicle is returned subject to the storage and pickup terms below.
4. Diagnostic Charges, Parts, and Labor
Diagnostic and inspection time is billed once authorized or initiated. Time spent diagnosing a concern is a service that is paid for whether or not the client proceeds with the repair.
Labor is billed as full-job service value — covering the complete job from access through verification and quality control — not visible wrench time only. Labor is built from the realistic requirements of the specific vehicle and procedure.
Parts policy:
- Parts installed by Woytek Auto are sold at the shop's price, which reflects sourcing, fitment control, and shop liability.
- Client-supplied parts are accepted only at the shop's discretion and are not the default path. The client remains responsible for the risk associated with a client-supplied part, including wrong part, incomplete kit, fitment mismatch, premature failure, and resulting downtime. Labor is not automatically reduced because the client supplied the part. Any acceptance of a client-supplied part is documented at the time of acceptance.
- Any parts warranty is limited to the coverage offered by the part's manufacturer or supplier unless otherwise stated in writing. No blanket Woytek Auto parts warranty is implied.
5. Limited Workmanship Warranty (90 Days)
Woytek Auto provides a 90-day limited workmanship warranty on labor performed by our shop, beginning on the date of service completion.
This warranty covers labor workmanship directly related to services performed, and labor associated with parts installed by Woytek Auto.
This warranty does not cover: client-supplied parts; manufacturer defects in parts; normal wear and tear; failures of unrelated systems; damage due to misuse, abuse, neglect, accidents, racing, or modification; aftermarket or non-OEM configuration failures; pre-existing conditions not repaired; or labor performed by any other facility.
If a defect in workmanship is verified within the warranty period, Woytek Auto will, at its sole discretion, re-perform the labor or refund the labor portion originally paid. This is the sole and exclusive remedy. All warranty claims must be submitted in writing within 90 days of the service date.
6. Vehicle Operation and Insurance Authorization
The client authorizes Woytek Auto to operate, test drive, and move the vehicle as reasonably necessary for diagnostics, repair, inspection, and quality control.
The client affirms the vehicle is insured at the time of service. In the event of an incident during authorized operation, claims are generally handled through the vehicle owner's insurance provider, except where damages result directly from verified negligence or willful misconduct by Woytek Auto.
7. Appointment, Cancellation, and No-Show Policy
When a client books a slot, that time is reserved and other work is declined for that window. A missed appointment is a real opportunity cost.
- Cancellations and reschedules made 24 hours or more before the scheduled time incur no fee.
- Cancellations, reschedules, or no-shows occurring less than 24 hours before the scheduled time are subject to a $50 late-cancel / no-show fee.
- By booking an appointment and providing a payment method, the client authorizes Woytek Auto to charge the $50 fee to the payment method on file if a late-cancel or no-show occurs as defined above.
- Woytek Auto may waive this fee at its discretion in genuine extenuating circumstances. A client who incurs a fee may re-book at any time.
8. Payment and Vehicle Release
Payment is required prior to vehicle release. The client is responsible for diagnostic charges once authorized or initiated, upfront payment for ordered parts, applicable shop supplies and taxes, and labor charges upon completion of authorized services. Authorized labor and ordered parts are non-refundable.
9. Vehicle Storage, Pickup, and Abandonment
Upon completion of repairs or diagnostics, the client will be notified by reasonable communication methods. The client has three (3) calendar days from that notice to either approve recommended repairs or pick up the vehicle.
Vehicles not picked up within that window enter storage status, and storage fees accrue at $50 per calendar day beginning immediately after the window expires. Vehicles left with unpaid balances, including storage fees, may be treated under applicable Florida law as abandoned or lien-eligible, and Woytek Auto reserves all rights permitted by law, including lien enforcement.
10. Liability and Risk Allocation
All services are performed with reasonable care and the professional standards applicable to independent automotive repair facilities. Motor vehicles are complex mechanical systems; failures, wear-related issues, or unrelated malfunctions may occur before, during, or after service and may not be connected to the work performed.
Client vehicles remain the responsibility of the vehicle owner, including collision, comprehensive, theft, vandalism, and related losses, except where damages result directly from verified negligence or willful misconduct by Woytek Auto.
To the fullest extent permitted by law, Woytek Auto is not responsible for incidental, consequential, or indirect damages, including loss of use, loss of income, downtime, diminished value, or additional repairs resulting from unrelated, pre-existing, or subsequently occurring conditions. Nothing in these Terms excludes liability arising from proven negligence or willful misconduct, and nothing in these Terms waives protections afforded under applicable law.
11. Media and Content Authorization
Woytek Auto may photograph and record video of vehicles, components, diagnostic processes, and repair procedures for documentation, marketing, educational, and promotional purposes, including use on websites and social media platforms.
By authorizing service, the client grants Woytek Auto a non-exclusive, royalty-free, perpetual right to use such media featuring the vehicle and repair process, and acknowledges that no compensation is owed for such use. No personal identifying information (name, address, phone number, or payment details) will be intentionally disclosed without separate written consent. License plates and VINs may be obscured at the shop's discretion but are not guaranteed to be hidden. The client may opt out of public-facing media use by notifying the shop in writing before service begins.
12. Acceptance of Terms
These Terms apply when the client authorizes service through signed, electronic, or verbal approval; estimate approval; scheduling with a service commitment; dropping off the vehicle; paying a deposit or service-related charge; or other conduct that reasonably shows acceptance. Services performed correspond to the associated estimate, invoice, or repair order.
13. Governing Law
These Terms are governed by the laws of the State of Florida. Any dispute will first be addressed through good-faith direct resolution. Venue and jurisdiction lie in the Florida county where Woytek Auto is registered.
